These terms govern access to ID Clearance background check, verification, monitoring, and related screening services. Using the service means the customer accepts the applicable terms for account access, orders, and screening workflows.

ID Clearance provides information services. Employment, licensing, eligibility, and other decisions remain the customer's responsibility.

Acceptance of Terms

Acceptance may occur when a user creates an account, submits an order, accesses the platform, or uses any ID Clearance service.

Users who do not accept the terms should not access the platform or order services.

Eligibility and Authorized Use

Services are intended for business entities and authorized representatives acting on their behalf. They may be used only for lawful, permissible purposes such as employment, contractor, or other authorized screening.

Personal, consumer, unauthorized, or otherwise impermissible use is prohibited.

Scope of Services

ID Clearance provides requested screening services, including background checks, verifications, monitoring, and related informational reports.

The services do not provide legal advice, employment recommendations, or final hiring decisions.

Customer Responsibilities

Customers are responsible for lawful use of services and reports. This includes proper disclosure, written authorization, permissible-purpose certification, and required pre-adverse and adverse action processes when applicable.

ID Clearance does not take responsibility for customer compliance failures or improper use of reports.

Compliance With Applicable Laws

Customers must comply with federal, state, and local laws that apply to screening, including the Fair Credit Reporting Act and applicable state consumer reporting laws.

Use of the services in violation of law is not permitted.

Accuracy, Data Sources, and Limitations

Reports may draw from public records, third-party providers, and direct contributors believed to be reliable at the time of reporting.

Records can be incomplete, delayed, corrected, or changed. No report should be treated as exhaustive.

Fees, Payments, and Purchases

Services are generally purchased one time unless a separate written agreement says otherwise. Fees are disclosed before order submission and may vary by product, jurisdiction, gateway fee, or add-on.

Once processing begins, fees may be non-refundable except where law requires otherwise.

Disputes and Reinvestigations

Individuals may dispute report information as provided by law. ID Clearance handles reinvestigations consistent with applicable consumer reporting requirements.

Customers should cooperate with required dispute procedures and avoid final adverse action during an active reinvestigation when the law requires it.

Intellectual Property

ID Clearance content, software, reports, trademarks, workflows, and methodologies remain ID Clearance property.

Reports may be used for authorized internal screening purposes. Resale, redistribution, or unauthorized use is prohibited.

Disclaimers and Limitation of Liability

Services are provided according to the applicable terms and available systems. To the fullest extent permitted by law, ID Clearance limits liability to the fees paid for the service tied to the claim.

ID Clearance is not responsible for indirect, incidental, or consequential damages to the extent allowed by law.

Indemnification

Customers agree to protect ID Clearance from claims, damages, or liabilities that arise from misuse, non-compliance, unauthorized access, or improper disclosure of reports.

This obligation can continue after service access ends.

Termination, Suspension, and Governing Law

ID Clearance may suspend or terminate access for misuse, non-compliance, or violation of these terms.

Governing law and venue follow the jurisdiction designated by ID Clearance, without regard to conflict-of-law rules.
